Boating While Intoxicated
Texas law prohibits anyone from operating a vessel while intoxicated (BWI)—that is, while under the influence of alcohol or drugs. This includes operating any boat, sailboat, PWC, water skis, sailboard, or similar device while intoxicated. Alcohol and drugs cause impaired balance, blurred vision, poor coordination, impaired judgment, and slower reaction times. Alcohol is a major contributor to boating accidents and fatalities.
According to Texas law, operators who have a blood alcohol concentration of 0.08% or greater are considered intoxicated.
